Masimo Unit Says Its ‘Launch’ of Apple Watch Rival Wasn’t a Sale

A manufacturer bought by Masimo in a multi-billion dollar deal last year asked a federal judge to dismiss it Apple’s Apple alleges patent infringement, arguing that Apple failed to prove Sound United sold a health-tracking watch that Masimo claims to have developed by “secretly copying” the Apple Watch.

“Apple made no plausible claim that Sound United sold the W1 in the United States,” Sound United LLC said in two lawsuits filed over a rival device called the W1 that Apple filed in October. We have responded in writing supporting our motion to dismiss the lawsuit.
